When a company establishes their own proprietary security force, they absorb all the risks relating to negligence, errors, omissions, claims and actions. In many states, individual security guards are not allowed to work freelance or as a 1099. Companies are prohibited from simply hiring and staffing security guard without first registering with the state as a Proprietary Employer of Security Guards and purchasing additional security guard insurance. Even after registering with the Division of Licensing Services, there are still tasks that an employer must do such as registering each security guard onto their roster with the Division of Licensing Services.
